What Does a Fire Do to a Certificate I Already Hold?
The Consequences Are Not Nominal
Worth stating plainly because owners under pressure sometimes consider shortcuts. Section 42-128.1-11 allows tenants affected by lead poisoning to recover up to three times their actual monetary damages where the landlord has violated lead safety laws.
Section 34-18-58 requires landlords to register rental properties and certificates with the Department of Health, and section 42-128.1-9 requires insurers covering compliant pre-1978 rental housing to include lead poisoning liability coverage at limits no less than the underlying personal injury limits, with proof of the certificate producible on request.
Does That Make These Properties Hard to Sell?

The Framing Question Applies Equally
Nothing about tenure changes the construction. This housing is of the same era as the rest of the city, frequently balloon framed with continuous wall cavities and interconnected joist channels, so fire can travel where it cannot be seen.
On a tenanted building there is an additional reason to establish the extent properly: units that appear untouched may sit above a stud channel that carried fire past them, and returning tenants to a unit on that assumption is not a risk worth taking.
Values Are the Constraint
Repair costs what the trades charge regardless of neighbourhood, and adding certified lead-safe work practices to that does not make it cheaper. Where finished values are more modest, a full repair can approach or exceed what the finished building is worth.
That is the honest constraint here, and it is why more owners in these neighbourhoods end up selling than in the stronger parts of the city.

The Sections That Govern a Tenanted File
Chapter 42-128.1 carries the framework: section 42-128.1-8 for owner duties, section 42-128.1-9 requiring insurers to include lead poisoning liability coverage since 1 November 2005, and section 42-128.1-11 for treble damages. Section 34-18-58 requires registration.
