Why the Framing Matters
Balloon framing was the standard method for wood-frame housing through the late nineteenth century and into the early twentieth, which covers a great deal of what stands in this city.
In it, floor joists are nailed directly to long vertical wall studs that run continuously from sill to roof, rather than each storey being framed as a separate platform sitting on the one below. There is no natural fire stop at each floor level to slow vertical spread.
The joist channels beneath the floors are also interconnected with the exterior wall stud channels. So a basement or interior fire that enters that void space can produce both vertical and lateral spread through the structure.

What That Means After the Fire Is Out
The point most owners are never told. Even after the visible flames are knocked down, hidden fire can continue to burn inside the wall cavities and travel upward or downward.
Fire services approach these buildings differently for exactly that reason, checking the attic void soon after arrival and using piercing nozzles to deliver water directly into concealed spaces through plaster or drywall. The rule of thumb among crews is that once fire gains the wall and floor voids it frequently dooms the structure.
So Is the Damage Always Worse Than It Looks?
The Attic Complication
A further feature of this stock that affects both the fire and the assessment. It is common to find a large finished room within the attic of these houses, which complicates access to a fire that has extended into the attic void and complicates inspection afterwards.
Many of these buildings have also been converted from single-family dwellings into multiple apartments over the years, frequently with a single narrow interior stairwell as the means of egress. That matters for what a rebuild would be permitted to be as much as for how the fire behaved.
We publish no structural conclusions, framing determinations or damage assessments for any individual property. Whether a particular building is balloon framed and what a particular fire reached are questions for a structural engineer and a fire investigator, and both require somebody on the site.
The Second Half: Rhode Island's Lead Regime
Rhode Island regulates lead in older housing more actively than most states, which follows directly from having some of the oldest housing in the country.
Chapter 42-128.1 of the General Laws establishes the Lead Hazard Mitigation programme, administered through the Housing Resources Commission and the Department of Health. Owners of non-exempt rental properties built before 1978 are required to obtain a Certificate of Lead Conformance.
What Does Obtaining One Involve?
How Long a Certificate Lasts
A Certificate of Conformance expires two years from the date of the last inspection and dust wipe sampling, or on turnover, meaning the point at which all existing occupants vacate and new occupants move in.
It may be renewed where the same tenant remains and the owner conducts a visual inspection looking for peeling, chipping, chalking or cracking paint, recorded on an Affidavit of Completion of Visual Inspection. An interior-only Certificate of Conformance must receive exterior clearance before 1 June to remain in force.
Why a Fire Ends the Position
A clearance certificate records that a dwelling passed a dust wipe test at a moment in time. A fire disturbs painted surfaces throughout a building, deposits the residue of those surfaces across every horizontal plane, and is invariably followed by occupants vacating.
Both of the things that keep a certificate alive, an unchanged condition and an unchanged tenant, are gone. So an owner of a pre-1978 rental is looking at a fresh inspection and clearance as part of any return to use.
What About the Repair Work Itself?
The Other Provisions Worth Knowing
Insurance. Under section 42-128.1-9, insurers issuing policies covering pre-1978 rental housing that is in compliance, or that relies on a valid certificate, have since 1 November 2005 been required to include lead poisoning liability coverage at limits equal to and no less than the underlying personal injury limits. An insurer may ask the owner to produce proof of the certificate.
Treble damages. Section 42-128.1-11 allows tenants affected by lead poisoning to recover up to three times their actual monetary damages where the landlord has violated lead safety laws.
Registration. Section 34-18-58 requires landlords to register rental properties and certificates with the Department of Health.
At transfer. The regulations require owners of pre-1978 housing to certify at the time of transfer either that the dwelling meets the requirements for lead hazard mitigation or abatement, or that the acquiring party is notified of the potential lead hazards.
Your Options, Compared
Open the walls and find out. Costs a few hundred and converts the largest unknown in the file into a fact. On this stock it is the highest-return step available.
Repair with certified trades. Lead-safe work practices on a pre-1978 building, and a fresh clearance inspection if it returns to rental use.
Sell as it stands. Transfers both questions to a buyer, with the notification duty at transfer still applying to you.
Close the walls without looking. The one route that destroys the evidence and guarantees every buyer prices the worst case.

Does the Lead Law Apply to Owner-Occupied Housing?
The certificate requirement attaches to rental dwellings. Lead-safe work practices on repairs to pre-1978 housing are a separate federal matter with broader reach.
Is My Certificate Still Valid After a Fire?
A certificate reflects a condition tested at a point in time, and both the condition and the occupancy typically change after a fire. Ask the Department of Health rather than assume.
Can I Open a Wall Myself?
On a fire-damaged building of uncertain stability, no. And on pre-1978 housing, disturbing painted surfaces is exactly what the lead-safe work practice rules govern.
